Kim Davis asks Kentucky governor to free her in same-sex marriage case


(CNN)Kim Davis, the Kentucky clerk who's refused to issue same-sex marriage licenses, on Monday asked the Kentucky governor to immediately free her from jail, according to court documents obtained by CNN.
"We would like them to release her from jail and provide reasonable, sensible accommodation so she can do her job," one of her lawyers, Horatio Mihet, said in a statement. "That would be taking her name off of marriage licenses in Rowan County and allowing her deputies to issue the licenses."
Kentucky Gov. Steve Beshear's office said Monday he won't respond, noting that the conflict was a "matter between her and the courts."

On Sunday, her lawyers appealed the contempt of court motion that sent her to jail five days ago. Her lawyers said they'd file arguments to back up their appeal later Monday or Tuesday.
Davis was reading the Bible in jail and "exudes gentleness and peace," Mihet said.
"Her spirits remain high," he said. "She was brought to tears when she heard that so many people outside the jail and around the country are praying for her."
    Supporters of Davis rallied Monday outside the home of U.S. District Court Judge David Bunning, who found Davis in contempt of court, CNN affiliate WCPO reported, and also outside the jail where she's being held, CNN affiliate WSAZ reported.
    Davis had refused to give licenses to same-sex couples after June's Supreme Court decision on grounds that issuing the licenses would violate her Christian convictions against same-sex marriage.
    Bunning ordered her to jail Thursday, ruling she was in contempt of court for refusing to issue the licenses and not allowing her deputies to distribute them for her. He said Davis would remain behind bars until she complies.
    Five of her deputies agreed Thursday to issue marriage licenses in her absence, and the Rowan County Clerk's Office began doing so the following day.

    Mihet said on CNN that Davis was "willing to stay in this jail as long as it takes in order for her to win back her constitutional rights not just for her but for Americans of all faiths."
    On Tuesday afternoon, a rally in support of Davis is scheduled to be held outside the Carter County Jail =m where she's being held. Mike Huckabee, a Republican candidate for president, said he plans to visit Davis in jail before the rally.
    Because of Huckabee's visit, five schools in east Carter County will close on Tuesday to alleviate traffic, said Sgt. Travis Steele with the City of Grayson. The closings will affect more than a thousand students, Steele said.
    One of Davis's lawyers, Mat Staver, founder and chariman of Liberty Counsel, said Beshear could issue an executive order to solve the problem.

    The legislature could pass a law removing clerks' names from the licenses, but it won't be in session until January.
    But Beshear said last week he won't call lawmakers for a special session to deal with the issue, adding that to do so would cost "hundreds of thousands of dollars of taxpayers' money."
    The governor added that he has no power to remove Davis from office.
    In court papers, attorneys for Davis argued that she is unable to comply with the court orders because issuing same-sex marriage licenses "irreparably and irreversibly violates her conscience."

    A federal prosecutor said it was time for Davis and her county to comply with the judge's ruling.
    "Government officials are free to disagree with the law, but not disobey it," U.S. Attorney Kerry B. Harvey said in a statement. "The county clerk has presented her position through the federal court system, all of the way to the U.S. Supreme Court. It is time for the clerk and the county to follow the law."

    Davis' lawyers said they were surprised when the judge ordered Davis jailed. They expected some other legal action, such as a fine.
    Daniel Canon, an attorney who was working with the ACLU on the case against Davis, said his clients had not asked for Davis to be jailed. But now that she is, he said, there should be "some assurance that Ms. Davis is not going to continue to impose her religious beliefs."
    Ryan Anderson, a senior research fellow at the Heritage Foundation, a Washington-based conservative think tank, said the legislature should remove clerks' names from the licenses as Davis has asked.
    "Hopefully she'll get out of jail because the state of Kentucky will realize that there are compromises we can reach that will protect both the rights of gays and lesbians to receive marriage licenses and the rights of someone like Kim Davis not to have her name on that marriage license," he said.
    Staver said Davis does not plan to resign. Anderson acknowledged that Davis could resign, but he said she shouldn't have to.
    "We have a rich history in the United States of accommodating conscientious objectors," Anderson said. "Kentucky accommodates conscientious objectors for other types of licensings. ... The question should be: If we can accommodate someone, why shouldn't we?"

      I think it's ridiculous that she denied them a marriage license in the first place. She can keep her beliefs about same sex marriage but she can't let that interfere with other's beliefs and rights as individuals. I don't believe that religion goes above the laws and you need to respect the laws, and accept that gay marriage is now legal. They didn't deny her of her rights because they're gay, and she can't deny them of their rigths because she's christian. I think she deserves jail time, she willfully disobeyed the law and should deal with the consequences of her actions.

    2. While Davis is asking the government to free her from jail, i believe she deserves to be in jail. She stated that the reason she denied marriage licenses for the same sex is because it didn't apply or follow her religion's belief. Its not her thats getting married to the same sex, its other people and those people should have the right to get that marriage license. If Davis ever does end up getting removed from jail, i feel she should be allowed to have a say in whether same sex marriage licenses should be issued or not.

      1. I agree strongly to the statement. I'm just surprised the government didn't fine her or ask her to resign from her job. I think that the government went a little to light on this case and should have fined her for something that she shouldn't be doing. She broke the law and I don't think that jail time is a big enough punishment.

Her job includes issuing marriage licenses to same-sex couples and if she is unable to preform that task she is not fit to have that job and should resign.     7. I think she should not have to stay in jail. She did deny people to get married. But she reserves the right to do what she wants with her career. She doesn't have to marry someone if she doesn't want to. I do think that because of her beliefs maybe she should be in a different career, but she does not deserve to be jailed. Same sex couples can get married by someone else. Its just like a restaurant owner doesn't have to serve food to all customers. They reserve the right to refuse anyone.

    8. I think that this issue is crazy. The fact that Davis refused to issue the "same-sex marriage licenses" is ridiculous (Ed Payne, CNN). Davis should not have let her religious beliefs get in the way of her job. Those people are different people than who she is and she cannot force them to believe in the same things she does. Maybe Davis doesn't deserve to be in jail for this, however she should definitely be removed from her workplace and some other form of punishment should be given for breaking the law. I agree with Ryan Anderson who said "the legislature should remove clerks' names from licenses" (Ed Payne, CNN). This makes sense so no issue can lead to whoever signed or aided in the establishment of the license.

    10. I do not believe that Davis should have been freed from jail. Being involved in a government job means that you uphold the laws of the government no matter what your personal opinions are. And Davis knows the laws and if she decides to break them, then i think she should be punished for that. I do not feel that her beliefs should effect whether or not others can or cant get married. And if she goes back to work and still interferes with the law, then that is even worse and that is not the right job for her. Adrianne Mahlman Period 6

    11. I personally do not believe she should be jailed. I do believe that she should resign and find another career however. I am completely okay with the thought it is against her religion but if that's the case then she should quit and find a different job. She should not be jailed because of her religious beliefs. Gays can find someone else for a marriage license and Davis should find a job that is right for her.

Same with everyone else, people are allowed to disagree with the law, but they are not allowed to disobey it. She should stay in jail for the amount of time necessary. Other than that, she is allowed to license all couples who want to get married, and if she doesn't want to allow same sex couples to get married, then she should have a different job.

    13. I believe that she should not be aloud out of jail until they find her a new career. She should already know the law and she should know not to break the law. Davis is not be the type of person to give out these licenses and everyone knows that. I think that Davis should be let out of jail only if she found herself a new job.

I believe that she should get jail time, and that the excuse that she was practicing religious beliefs as a reason for not getting jailed is not valid at all. She was jailed for breaking the law, not for practicing religious beliefs. So yes, I believe it was right to jail her, she broke the law. If she is released from jail, she should have to pay a large fine regardless, as well as be forced to resign from her job unless she agrees to start issuing marriage licences to same-sex couples, and tell her deputies to do the same.     15. I do not agree that Davis should stay in jail. It is her job and she should have the right to not marry someone if she does not want to. If Davis doesn't want to marry someone that she doesn't want to, those people should just go to somebody else with a marriage license. She is just supporting her faith and if she does not want to marry them, she should not have to. If this is a continuous problem, I think its best that she finds a new career.

    16. I think it was very wrong of Davis to refuse giving out the same-sex marriage license. Davis believes that giving out the license goes against her religion which is fine, but she was "not allowing her deputies to distribute them for her"(Payne). She should have no problem having someone else distribute the license for her, because she has nothing to do with it. This couple was not going to affect her life in anyway, and she was interfering with their freedom to be together legally. If handing out licenses of same-sex marriage bothers her and her religious beliefs so much, she needs to find a new job. She blew this problem way out of proportion, and it is now a huge deal. I believe she deserves jail time to really reflect on what she has done. She needs to think about how her "rights" start limiting other people's rights in this country.

    18. I think it is wrong for Davis to refuse a marriage license. I understand she is coming from a religious standpoint although as of June 26th Same sex marriage was legalized. This means she is breaking the law by refusing to marry them. "Government officials are free to disagree with the law, but not disobey it," U.S. Attorney Kerry B. Harvey said in a statement. She could of had another person handle the marriage instead of refusing it. She broke a law and now suffers the consequences. I don't think she would be a better in another career.

    20. I believe that religion and state should be separate. She very well knew with the recent passage that the Supreme Court made on legalizing gay marriage would affect her job. Her position in the county determined other people's legal rights and I believe if she felt she could not complete her duty assigned by the government she should have resigned from her job not refused to marry the gay couple.     21. Though Kim Davis denied others of their rights and failed to uphold her civic duty, i do not believe she should be in jail. I do believe that she should be forced to resign because she failed to do her job and directly disobeyed an order from a higher up. In every other job this is grounds to fire someone and i do not think her job should be an exception. I also think that the idea of her trying to protect her beliefs is stupid because she was not hired to do what she wants, but what the people want.

I believe that everyone has an opinion and should be able to express their opinion but taking away the privelage of same sex marriage from Americans is not right and should not be tolerated. Mihet states that Kim Davis "is willing to stay in this jail as long as it takes in order for her to win back her constitutional rights not just for her but for Americans of all faiths" (Mihet). The fact that she is willing to stay in jail just to take away the rights of others to be happy is proof that she should be kept in jail and not have a saw in law-making.

    23. I believe that everybody is entitled to their opinion. However, Davis cannot deny the right of marriage just because she does not agree with it. It is against the law to do what she did, and she knows it. I think she should be in jail for now and when she does get out of jail she needs to find a new job. I agree with U.S. Attorney Kerry B.     24. I believe that Kim Davis should not be mixing her religious beliefs with her work. Although she has the right to marry two people or to not marry them, she should not refuse to marry them just because it is against her religious beliefs. It is wrong for her to be in jail though, she did not harm someone therefore she doesn't deserve to be in jail. It is more understandable for her to be fired from her job, jail is way too extreme. But if she has such a big issue with gay marriage, at this point she should quit her job and find another career now that gay marriage is legalized.

On the other hand, the same sex couple wants to get married and that is their choice too. Neither of them are wrong for what they believe in, but Kim should realize that she can not successfully complete that job and should resign. She deserves consequences for her actions. Jail may be extreme, but if it was her decision to deny them their right to marriage, so she has to deal with the repercussions.

    27. I strongly believe in this article and Kim Davis did have the right to go to prison. Her beliefs are what she believes in and that's fine but with her job she has, she needs to do her job correctly. If she is going to be against the marriage then why does she even do that job? She needs to quit her job and find a new one. Going to prison for what she did is acceptable but her punishment should not be extreme.

In the United States people are allowed to believe in whatever they'd like and follow whatever religions they'd like. That being said, you should keep your work life and your personal life separate, especially if it is something like giving a gay couple a marriage license they deserve and have earned the right to receive. People who work have the right to disagree with a legalized law in their personal life, but are still expected to obey the law in their work life. If it conflicted so greatly with Kim Davis's life she should have just quite and found a new job that better suit her lifestyle.

    29. After reading this article, I strongly believe that Kim Davis should go to jail for refusing a gay couple their legal right. We have laws and rights in the US, we are a free country and you can do or say whatever you want. You can follow whoever you want and love who you want. If somebody wants to get a gay marriage license, then let them it's the same thing as getting a normal marriage license. They had the courage to come out as a couple together, they deserve the marriage license. If Kim Davis can't stand the thought of gay marriage that much then she should find a new job because gay marriage is legalized now so she'll probably be seeing a lot more of it.

    30. After reading this article, I would first say I respect Kim's decision. It's hard for some people to choose between their beliefs and the law. I'd say her request should be denied, and should continue to stay in jail. She knew that "same-sex marriage" is legal since June 26th of 2015 (Map: Same-sex marriage in the United States). She should have known the consequence of her actions if it has to relate to her beliefs. If Kim Davis didn't want to be in jail she should have in my opinion, find herself a different career that doesn't contradict her religious beliefs.

    31. After reading this, I strongly agree with the punishment Davis received. There was a law passed over the summer that legalized Gay Marriage in all states. Just because her religion says differently, doesn't mean Davis has the right to deny the someone the right to gay marriage. I also believe that because Davis's religion causes big conflicts in her career she should be forced to resign. She is denying Americans a right they were promised by law, that is in no way fair.

    32. The legalization of gay marriage in all fifty states as of June 26th means that regardless of personal opinions or religious perspectives you need to tolerate same sex couples. You have a right to your own personal opinion and you don't need to accept them but in order to create a more accepting atmosphere to others around us we should be accepting and loving of all people regardless of things like their sexual preference, race, gender, etc. I think putting Kim Davis in jail for refusing to issue the same sex couple's license was an accurate punishment. The couple had a right to be married just like any other straight couple would have the right.     34. I defiently agree with the punishment for Davis. The law was passed over the summer that said that gay marriage was legal in the states. I don't think that Davis should be trying get her beliefs and her job mixed in the same situation. I think that she should've treated this like any other couple she has handled. If this is such a big conflict for her and her job, I think that she should step down from her position so it doesn't cause anymore problems that may be erupted. It is not fair that she isn't allowing others to get something that our government and law says that they can have.

Even though she has the rights to refuse giving the couple their marriage licence, because it's her job and she can make her own decision. However, the government already made the law, so she should following the rules. Since the couple had the courage to come out as a "couple" together, I think they deserve the marriage license. Yes, I understand same-sex marriage is against her religion, but, no matter what, everyone should get the privilege to marry in any state. Couples should not have to travel to another state just because they cannot get a marriage license in the state they are living in. As stated, Kim Davis refused to perform a same-sex marriage after the supreme court approved it. She broke a law, and if she could not marry people of the same sex she should have stepped down from her position. Her strong attachment to the bible shows that she is introducing religious bias. When it comes down to it, one of the fundamental points to US law is the separation of church and state. She has no right to deny the right of others, nor can she prevent others in her office from granting those rights.

    39. Many of this world's problems revolve around religion, mainly because somebody is always trying to force their belief on somebody else. In this case Kim Davis is denying people their LEGAL right to be married. It is ok to be against something, but do not force it upon other people, or in this case not give them a marriage license. I believe that it is great to love your religion and to practice it, just don't make other people miserable over it. I agree that she should stay in jail.

No matter her personal beliefs and opinions, she has to wake up and realize that same-sex marriage is legal.Her religion and personal beliefs can't take place over her job.     43. First of all I find it insane that Davis would deny same sex marriage. This is 2015 in The United States of America and we are allowed to love and marry people of the sames gender and should not be judged. (CNN politics). This is also frustrating because as a citizen of the United States we have a freedom to believe in any religion we choose and our actions can reflect our religious beliefs, but if you are in a position where other peoples rights go against your beliefs you should not be allowed to refuse someone that right. For these reasons upon basic United States free rights, Davis should remain in jail and should not be released. Case closed

    45. I agree with the punishment being given to Davis. No one should be able to deny people of their own marriage rights, especially now since it is legal in all 50 states. Everyone is entitled to their own opinions, however, going out of your way to deny someone elses happiness and marriage is unacceptable.     46. Davis did deserve jail time. You can't just take away someone's rights just because you disagree with how they live their life which has no affect on anyone else. Davis is trying to gain sympathy when she says she was "willing to stay in this jail as long as it takes in order for her to win back her constitutional rights not just for her but for Americans of all faiths." She complains about her freedom of religion rights being violated, which have not been violated, yet she is perfectly fine with taking away the right to marry for the same sex couples.

    47. She deserves punishment. She disregarded the law and didn't allow someone to get married. Just because her religion says she can't do it doesn't mean she should stop people from following their own beliefs. She seems very caught up with her own belief she couldn't even realize people are different and have different morals. If she doesn't think she did something wrong even though she is in jail she should not be released but instead fulfill her punishment for breaking the law.

    48. I do not think Davis should be put in jail because of this. She should be fired though for failing to do her job. "Davis' lawyers said they were surprised when the judge ordered Davis jailed. They expected some other legal action, such as a fine." (CNN). Although it is her job to give anyone a marriage license, she should not be put in jail for what she believes in.

    49. I dont think that she should be put in jail. I know that it was a mistake for not giving a license. Its is not good that they locked her up for that. Kim Davis, the Kentucky clerk who's refused to issue same-sex marriage licenses, on Monday asked the Kentucky governor to immediately free her from jail, according to court documents obtained by CNN.(cnn)

    50. Computers and the ability to go online during a school day is vital for our learn and we used probably doing more of it. With how great technology is today why not use it and if we don't we may not be ready to use higher level technology when we get older. What about ICT, you have to take ICT if you are wanting to graduate from Oak Ridge High School without computers we don't even get to have that class. There are so many reason for students to have the ability to go on computers and online during school so if we limit the use of them we are limiting the learning

    52. After reading the detailed and well-written article on computers and using the internet at school, I came to the conclusion of internet is definitely a vital part to our base of learning. I think that it is great that we have what seems to be an unlimited amount of information at our fingertips. It is such an important part of our generation and the way way we learn. Something like this should most definitely be taken advantage of because it's there, so why not use it.

    53. The school department changed many of the thoughts about technology in their age. Many people think that having technology is bad in our time because we use it enough already and bringing it to school will cause more addiction. I think that computers do not help your pupils at all in fact i believe sometimes they can hurt your eyes. Whenever i am on my phone my eyes start to hurt so i think that they do not help your eyes.

    54. There always seems to be new studies coming out saying how technology is good for use on school, and then there are others saying that it is bad for use in school. This one states that most of the technology use on schools is ineffective. I think that this is not the technology's fault. Just like technology there are retain teachers who's methods of teaching are ineffective.     55. I agree with the punishment given to Kim Davis. An elected government official does not have the right to be discriminatory towards gay or lesbian couples. The law across the nation has given everyone the right to love and marry who they want regardless of gender. She is specifically going out of her way to deny people of what they legally deserve in the United States. Everyone has their own opinion but an elected official has no right to deny marriage licenses to gay or lesbian couples.
